Welcome to SoulCentements (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, www.soulcentements.com, and any related services, content, products, or programs offered by SoulCentements (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Site.
 

1. Acceptance of Terms
 

By using this Site, you represent that you are at least 18 years old or the age of majority in your state of residence, and that you have the legal capacity to enter into this agreement.
Your continued use of the Site constitutes acceptance of these Terms and any updates we make to them.

We may modify or update these Terms at any time without prior notice. Updates will be effective immediately upon posting on this page. You are responsible for reviewing this page periodically to stay informed of any changes. Continued use of our Site after such modifications constitutes acceptance of the updated Terms.
 

3. Our Products and Services


SoulCentements provides holistic wellness products, self-care items, digital downloads, and coaching services rooted in our proprietary Soul-Centered Mental Wellness Model.
We make every effort to describe and display our products accurately, but we cannot guarantee that colors, textures, or details will appear exactly as shown on your device screen.
 

4. Orders and Payments
 

  • Order Acceptance: All orders are subject to availability and acceptance. We reserve the right to refuse or cancel any order at our discretion.

  • Pricing: Prices are listed in U.S. Dollars (USD) and are subject to change without notice.

  • Payment: Payment must be made at checkout using approved methods (e.g., credit/debit card, PayPal, or other listed options). You agree to provide accurate billing information.

  • Taxes: Applicable sales tax will be added as required by federal or state law.

  • Shipping: Shipping fees and delivery estimates are provided at checkout. Once your order ships, risk of loss passes to you.


5. Refunds and Returns


We want you to love your SoulCentements experience. Our full Return & Refund Policy explains eligibility and procedures.
Generally:

  • Returns must be requested within 14 days of receipt.

  • Items must be unused, unopened, and in original packaging.

  • Digital products (e-books, journals, downloads, etc.) and personalized items are non-refundable once delivered.

Refunds will be processed to your original payment method. Shipping costs are non-refundable.
 

6. Coaching Services


By purchasing coaching sessions, you acknowledge that SoulCentements coaching is not therapy, counseling, or medical treatment. Coaching is a collaborative process that provides guidance and tools for personal growth and well-being.
You accept full responsibility for your choices, actions, and results following any coaching session.
 

7. Intellectual Property


All content on this Site—including text, graphics, logos, images, videos, digital downloads, and trademarks—is the property of SoulCentements or its licensors and protected under U.S. and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, or use any materials from this Site for commercial purposes without prior written consent.
 

8. User Conduct


You agree to use our Site only for lawful purposes. You must not:

  • Engage in fraudulent or deceptive activity;

  • Upload viruses, malware, or harmful code;

  • Violate any local, state, or federal laws;

  • Any unauthorized access to or alteration of your data.

Our total liability to you for any claim shall not exceed the amount you paid to us for the product or service in question.

You agree to indemnify, defend, and hold harmless SoulCentements, its owners, employees, and affiliates from any claim, loss, liability, or expense (including attorney’s fees) arising from:

  • Your violation of these Terms,

  • Your misuse of the Site or Services, or

  • Your infringement of any rights of a third party.
     

13. Governing Law


These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Any dispute shall be resolved exclusively in the state or federal courts located in Richmond County, New York, and you consent to personal jurisdiction there.
 

14. Arbitration and Dispute Resolution


Before filing a lawsuit, you agree to attempt informal resolution by contacting us at Drmaxine@soulCentements.com.
If no resolution is reached within 30 days, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).
You agree to waive your right to participate in a class action or jury trial.
 

15. Severability


If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
 

16. Termination


We may suspend or terminate your access to our Site at any time for violation of these Terms or misuse of our Services.
All provisions which by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will continue to apply.
